The case which went on for more than a decade was being closely followed globally as it was one of the biggest cases involving transfer pricing. As the dust settles, the major take away from the case is that implementing the arm's length principle is easier said than done. The case also goes to strengthen the fact that it is not a cake walk to traverse through the nitty gritties of transfer pricing laws. Transfer pricing is regarded as one of the most controversial operations of multinationals resulting in tax avoidance and arbitrage. This is why the laws keep evolving and getting more stringent by the year. In the Indian context one must note that the economy is on an upward growth trajectory and paving a smooth way for foreign investment plays a major role in this scenario. Transfer pricing rules greatly affect the large volume of inter-company dealings and thus have a great impact on our economy. Adding to this conundrum, the Finance Act 2012 rendered domestic transactions between related entities also subject to the law of transfer pricing, to avoid tax arbitrage between states. As a result, transfer pricing laws are just getting more complex by the day. And, non compliance to the laws can have catastrophic ramifications for the respective organizations. This is where the need for competent consultants arises. These subject matter experts are well versed with Indian as well as international laws and help organizations traverse the complex road of transfer pricing.
